General

These Terms and Conditions (hereinafter “Terms” or “Terms and Conditions”) govern your

relationship with https://www.cyprusinthesunholidays.com/ website (the “Service”) operated by

PGT Cyprus In The Sun Holidays Limited (hereinafter “us”, “we”, or “our”).

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with

these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with

any part of the Terms, then you may not access the Service.

PGT Cyprus In The Sun Holidays Limited is directly or through a third party, a booking agent,

representative and/or reseller, dealing on behalf of private owners and/or property

managers/agents (hereinafter “Property Owners”) offering accommodation in Cyprus.

 

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive

property of PGT Cyprus In The Sun Holidays Limited and its licensors. The Service is protected

by both Cyprus’ and foreign countries' copyright, trademark, and other laws. Our trademarks

and trade dress may not be used in connection with any product or service without our prior

written consent.

 

Links To Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled

by us.

We have no control over and, assume no responsibility for, the content, privacy policies, or

practices of any third-party websites or services. You further acknowledge and agree that we

shall not be responsible or liable, directly or indirectly, for any damages or loss caused or alleged

to be caused by or in connection with the use of or reliance on any such content, goods, or services

available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party

websites or services that you visit.

 

Property Names

All property names featured on our website are used solely by us for marketing purposes and

may differ from names used by property owners and/or other marketing companies.

 

Reservations

 

Once you have completed the online booking, we will process your reservation and send you a

booking confirmation by e-mail.

Your booking will not be confirmed until a deposit has been received. Once the deposit is paid,

we will confirm your booking with the private owner and send you a confirmation within 24 hours.

Bookings are only available to persons at least 18 years of age.

 

Payment Terms

To confirm your booking, we require a 30% deposit of the total accommodation cost. The full

balance of your booking arrangements is due 10 weeks before your arrival date, whether

demanded by us or not. If this is not paid within 7 days of it being due, then we reserve the right

to cancel the property booking without any refund.

We will not accept responsibility for cash sent through the post. Payment can be made by bank

transfer to our bank account only, or by debit/credit card (on the latter a 3% bank charge will

apply).

 

Confirmation

Please always check your booking summary confirmation and all other documents you receive

from us immediately. You must contact us straightaway if any information appears to be incorrect

as it may not be possible to make changes at a later stage.

On top of that, we might send various automated emails to the email address used whilst booking

your holiday. Those emails are related to bookings terms and conditions, directions to the

property, instructions on how to access the holiday property and finally information about the guest

list. Therefore, it is the customer’s responsibility to acknowledge and agree with the content

provided or request additional clarifications. Unless we hear from you otherwise, we understand

that you understood and agreed with the entire conditions and information provided.

We are responsible for providing the holiday home we have confirmed with you. If you cancel or

alter your booking at any stage later, you may have to pay a cancellation fee, or an amendment

charge respectively. Booking is confirmed when the deposit payment is reached our bank and

relevant confirmation is provided to you.

 

Cancellations

Cancellation by You

All cancellations must be submitted to us in writing, either by email at

bookings@cyprusinthesunholidays.com or by post and will be considered effective from the date

of receipt by us.

You may cancel your booking at any time; however, a cancellation fee will apply as follows:

 If more than 10 weeks before the arrival date: 30% of accommodation cost (deposit).

 Between 8 to 10 weeks before arrival: 50% of accommodation cost.

 Less than 8 weeks before arrival: 100% of accommodation cost.

Although, any money paid, may be transferable to another booking date if such a request is

communicated to us more than 10 weeks away from the arrival date.

 

Cancellation by Property Owners

The property owner reserves the right to cancel any reservation. In this unlikely event, you will be

offered the option of renting another property (subject to availability) with the price difference

payable/refundable as appropriate or a full refund. We will not pay any compensation.

 

Property Check-in / Check-out Times

Arrival check-in time is 16:00hrs and you should vacate the property no later than 11:00hrs on the

day of departure.

Please note that an additional fee could be imposed for late check-outs dependent upon your

departure time. Upon making any reservations, please consider that your flight may arrive in the

early hours of the morning or late in the previous evening, in which case, if you require immediate

access to the property, you should add an extra night to your rental period. This may equally

apply to your departure, where your flight might leave late at night or early the next morning

whereby you need to add an extra night to your rental period.

Late check-outs are at the discretion of the property owner and the availability of the property and

cannot be confirmed in advance unless they are paid for.

 

Holiday Insurance

We strongly recommend you arrange for holiday insurance before your holidays.

In case of cancellations or accidents that may occur during your holidays, our role is to provide

witnesses and information to both guests’ and property owner’s insurance companies. It is

expressly clarified to the guests that the property owner’s representative/reseller will not take

any responsibility in such cases. Such an unfortunate event, if ever happens, will be sorted out

between the guests and the property owner.

 

Pool Heating

Please note that pool heating will only increase the temperature of the water, in most cases, by 3-

5 degrees maximum above the outside air temperature. If you would like the pool

temperature to be at its maximum, you need to notify us at least 72 hours before your arrival

date. Pool heating is charged extra at Euros (€) 50-100 per day depending on the property and

the pool size.

 

Electricity Fair Usage

For any bookings that are made with us for any of the properties featured on our website, the

amount of electricity usage per week which is included in the weekly rental price is as follows:

 3-Bedroom properties include 250 units per week, any additional units are charged at

Euros (€) 30 cents per kWh.

 For 4-bedroom properties with 300 units per week, any additional units are charged at

Euros (€) 30 cents per kWh.

 For each additional bedroom, the base free amount will increase by 50 units and the

charge for the extra units used will always be Euros (€) 30 cents per kWh unless specified

differently in the booking conditions of the property.

 

Before you arrive at the property, a meter reading will be taken for the electricity and a reading

upon your departure will be taken. Where applicable the extra charges will be deducted from the

security deposit.

 

Air-Conditioning

The use of air-conditioning is the responsibility of all members of the party. Please ensure that it

is only used when the property is occupied. All windows and doors are to be kept firmly closed

when the air-conditioning is in use and under no circumstances are the units to be left on

continuously while the property is unoccupied. Unreasonable use of air conditioning will result in

unfair use of electricity and in such an event it will be deducted from your security deposit.

 

Occupancy

The number of occupants shall not exceed the number stated in the property specifications. In

such an event, the property owner has the right to terminate the booking and request vacant

possession of the property within 2 hours without any refund.

It is not permitted to sub-let all or part of the property to any other person or persons. It is also not

permitted to allow other people to stay at the property or use the property’s facilities without prior

notice.

 

Changes to Property Specifications

We act solely as managers or resellers for property owners and, as such, cannot control or

prevent changes being made to properties. Although changes to properties are infrequent, we

reserve the right to change the description of any property or service at any time. We shall

endeavour to notify you of any changes before your arrival date if it is practical to do so. No claims

will be accepted for costs or additional expenses incurred because of any changes and no

compensation will be paid.

 

Building Works

We undertake to notify our clients as soon as we become aware of any construction activity which

may affect their enjoyment of a rental property. However, we cannot be held responsible for

construction work, carried out by third parties, in proximity to any of the properties listed on our

website. We are generally not notified in advance and are not involved in the planning of these

works. In most cases, we are in no position to prevent or demand the cessation of any construction

work.

 

Breakages, Damage and Cleanliness Deposit

All accommodation is available for letting on the understanding that the properties will be left

clean and tidy at the time of check-out and all personal litter must be removed from the property.

Customers are not permitted to move any furniture or equipment without our prior consent or the

property owner’s prior consent. In the event of such permission being granted, it is the customers’

responsibility to return the same to its original location before check-out. Under no circumstances

should any furniture or other items, made for use inside the property, be moved outside.

Before your arrival, a minimum-security deposit of Euros (€) 150 per property (some properties

require higher amounts – if this applies to your property you will be notified in advance) will need

 

to be blocked on your credit card or maybe taken in cash upon arrival. This amount is dependent

on the risk level of the party. The occupancy of a rental property is subject to conditions of Fair

Use. We accept fair wear and tear to the property, its furniture, equipment, fixtures and fittings.

However, damage above and beyond that, which may normally be considered fair wear and tear,

caused or carried out by the occupant(s) or by guests of the occupant(s), will be deemed to be

the responsibility of said occupant(s) and financial compensation will be sought. This

compensation is not limited to the amount of the security deposit. In the event of such

an occurrence, the incident must be reported to the property owner, immediately.

Furthermore, a consistent abuse of the property and/or its contents may result in summary eviction.

 

Behaviour and Common Sense

At all times during your holiday, you are expected to have consideration for your fellow group

members and other third parties. All visitors are kindly requested to conduct themselves reasonably and responsibly which does not cause offence or danger to others or risk

damage to property/property premises / premised belongings or any belongings of others.

Please use common sense about others by not creating excessive noise. To avoid injury, please

refrain from running on tiled flooring while your feet are wet. Do not sit on furniture or bedding

when you are wet or wearing sun lotion.

Please treat the property with respect so that others may enjoy the accommodation too.

 

Extra Services

We are only providing you with access to the extra services such as car hire, excursions and local

activities through our website.

These services can involve an element of risk and are neither run nor controlled by us. If you wish

to participate, purchase, or make use of any such services that are not part of your

accommodation package, we regret that we cannot accept liability concerning these. The

contract for the provision of such services will be between you and the service provider. Usually,

these locally paid services will be subject to local law and jurisdiction. The discretion to partake in

any such services is entirely at your own risk. You are responsible for taking sensible precautions

for your safety and for the safety of any children or family members for whom you are

responsible. Furthermore, the service providers have their terms and conditions which we

strongly recommend reading them.

Any complaints you may have with any of these services should be dealt with by you directly with

the service providers. We accept no responsibility.

 

Liability

In consideration of the fact that we act only as a booking agent, representative and/or reseller of

accommodation properties, no liability whatsoever is accepted on behalf of the property owner for

any aspect of the arrangements and, in particular, for any loss, personal injury or death, however

incurred, except where an act or omission is a result of willful misconduct or gross negligence on

our part.

We will not be liable if faced with Force Majeure (i.e., unusual and unforeseeable circumstances

beyond our control), the consequences of which we could not avoid. These include, but are not

limited to, oversights or errors by third parties, war, riot, civil commotion, terrorist activity, natural

or nuclear disaster, industrial dispute, fire, flood, adverse weather conditions or the threat of any

of these.

 

All properties are cared for and maintained by the property owners. We cannot be held

responsible for any breakdown of mechanical equipment such as washing machines, dryers,

dishwashers, fridges, freezers, swimming pools etc., although, we will endeavour to repair the

the problem as soon as possible. We and/or the property owners shall not be liable to pay any

compensation.

No responsibility is accepted by us and/or the property owners regarding the occupants; personal

safety or any accidents or injury sustained on the property grounds. Particularly, your attention is

requested regarding the supervision of children when using spas and swimming pools, as no

lifeguards are on duty.

 

Applicable Law and Jurisdiction

These Terms and Conditions and the provision of our Services shall be governed and construed

per the Laws of the Republic of Cyprus. In the event of any claim and/or dispute

arising out of these Terms and Conditions and /or our Services shall be exclusively submitted to

the Courts of the Republic of Cyprus.

 

Complaints

If you have a complaint during your stay regarding your arrangements, you must inform us

immediately and we will do our best to resolve the problem on the spot. We will not entertain

complaints submitted retrospectively if we were not informed at the time of the occurrence.

 

Disclaimer

While every care has been undertaken to ensure all information, descriptions, photographs and

specifications are as accurate as possible; they are meant only as a guide. While we are

committed to providing the best possible service to our clients, we will not be held responsible for

any errors or omissions and no warranty is implied or given. Please note that specifications,

photographs and prices are subject to change without notice and photographs may be digitally

altered and/or cropped for performance reasons.

 

Data Protection Policy

To process your booking and to ensure that your accommodation arrangements run smoothly

and meet your requirements, we need to use certain information that you will provide us with such

as name and surname, telephone number, email address, any special requirements you may

have etc. We take full responsibility for ensuring that proper security measures are in place to

protect such information collected. We must pass the information on to the relevant suppliers of

your arrangements such as car hire companies, transportation companies etc. However, we will

not pass any information to any person who is not responsible for any part of your

accommodation arrangements. This applies to any sensitive information that you give us such as

details of disabilities or religious requirements. For more information about our data protection

policy, please refer to our Privacy Policy.

 

Health and Safety Conditions

All accommodations offered are subject to health and safety conditions. Animals and pets

are NOT permitted in the property/property premises at any time. As a guest, you will be

requested to place all the rubbish in the green bins provided, which in most situations can be

 

found near the property or outside of each development. It needs to be noted that all properties

do not permit smoking inside because it can cause damage to any furnishings or materials.

However, smoking is not forbidden outside of the properties, all property premises, communal

areas and their facilities should be respected; cigarette ends and/or any other objects are not to

be thrown on the floor but placed in the appropriate bins/places.

Below we are listing some points that the guests should consider of vital importance to his / her

own safety and the safety of the people that stay within the property.

Property usage

Below, we have prepared a summary of useful guidelines which we kindly request from you to

always follow:

 Be cautious whilst using any of the electrical appliances within the property and kindly do

not use electrical appliances (e.g., hairdryers, shavers etc.) that are faulty, or do not

comply with the European Union rules and regulations;

 Do not leave any appliances in operation during your absence, including air conditioners.

Please refer to paragraph “Air-Conditioning” above;

 Do not misuse water in any form;

 Use necessary caution while opening or closing doors, windows, cupboards, wardrobes

etc.;

 Furniture or furnishings are not to be removed from the specified areas;

 The use of charcoal barbecues on the property's ground floor areas is allowed if you take

the necessary safety measures;

 Smoking is strictly prohibited inside the property;

 Parking is allowed only in the designated parking area;

 In the interest of safety, bicycles, tricycles, skateboards, and skates are not to be used or

left on the common pathways including sidewalks, driveways or parking areas;

 Children must not stay unattended at any time during your vacation or visit;

 In case you notice any trespassers, or anything suspicious, please contact the local

police station.

Pool usage

The below conditions are strictly compulsory. Each pool is commonly serviced twice a week,

however, the maintenance effectiveness may be affected if you do not comply with the following:

 Children under the age of twelve (12) years are not allowed in the pool area unless

accompanied by a responsible adult;

 Do not leave kids and infants unattended in the swimming pool area;

 The swimming pool, and/or other facilities are for the exclusive use of residents and them

guests;

 Residents and their guests shall use the swimming pool and or other facilities at their own

risk;

 Always have a shower to remove all kinds of oily sun protection lotions as they affect the

effectiveness of the maintenance circle;

 Whilst the use of the pool is strictly from 09:00 am until 06:00 pm, we advise the swimmers to

allow sufficient time for the water to rest i.e., not to enter the pool within the open usable

period;

 Persons using the pool may use swim and play aids such as floatation belts, but those

items must be removed from the pool when the user leaves the water and safely stowed

away so as not to be a hazard to persons walking on the pathways or entering the pool;

 No scuba equipment is allowed in the pool (however face masks, goggles and snorkels

or breathing tubes are acceptable);

 There will be no diving, running, pushing, roller skating, skateboarding or other similar

games, in the pool area. No water guns are allowed;

 Properties do not provide the services of a lifeguard;

 

 In case you wish to have a party on the property or its surroundings, please seek written

authorization from one of our staff.
